Property Law · Nelspruit

Property law attorneys in Nelspruit.

Property is often the biggest asset a person owns. We advise owners, buyers, landlords and tenants on agreements, disputes and the rights attached to land.

Property Law

Advice on the assets that matter.

Property matters involve large sums and strict legal formalities. A missing clause in a sale agreement or a poorly drafted lease can cost far more than the advice that would have prevented it.

We draft and review property agreements, advise on rights such as servitudes, and act in property disputes, including lawful evictions.

Questions

Frequently asked questions.

General information only, not legal advice on your specific matter. For advice on your situation, speak to one of our directors.

Does a property sale agreement have to be in writing?+
Yes. An agreement for the sale of land must be in writing and signed by the parties, or by their agents acting on written authority. A verbal sale of land is not enforceable.
Can a landlord evict a tenant without a court order?+
No. Evicting someone from their home requires a court order and must follow the procedure prescribed by law. Changing locks or cutting services to force a tenant out is unlawful.
What is a servitude?+
A servitude is a right over someone else's property, such as a right of way across a neighbouring farm. Servitudes are created by notarial deed and registered against the title of the property.
What should a lease agreement include?+
At minimum: the rent and escalation, the deposit and how it is held, the lease period and renewal, maintenance responsibilities, and what happens if either party breaches the lease.
