Litigation is expensive, slow and stressful when it is run badly. Our approach is to assess the merits honestly at the start, tell you what the matter is likely to cost and how long it could take, and look for a sensible settlement wherever one is available.

Where a matter has to go to court, we act in the Magistrate's Court and in the High Court, Mpumalanga Division, Mbombela. We act for individuals, businesses and landlords, both bringing claims and defending them.

How we help

What we handle.

i

Contract disputes

Claims arising from breached agreements, non-payment, defective work and cancelled contracts, for businesses and individuals.

ii

Damages claims

Claims for financial loss and damage caused by another party, including assessing what can realistically be recovered.

iii

Commercial disputes

Disputes between shareholders, partners, suppliers and customers, handled with an eye on the commercial outcome, not only the legal one.

iv

Urgent applications

Interdicts and other urgent relief when waiting for a normal court date would cause real harm.

v

Defending claims

If you have received a letter of demand or a summons, we assess your position and file your defence within the time limits.

vi

Settlement and mediation

Negotiated settlements and mediation where they serve you better than a trial. High Court rules now require parties to consider mediation.

How your matter moves forward.

A director handles your matter personally and keeps you informed at every stage.

01
Assess the matter

We review your documents, explain your position and give you a realistic view of the merits, costs and timeline.

02
Try to resolve it

A letter of demand, a meeting or mediation often settles the dispute without a court case.

03
Litigate if needed

If it has to go to court, we draft the pleadings, run the case and appear on your behalf.

Questions

Frequently asked questions.

General information only, not legal advice on your specific matter. For advice on your situation, speak to one of our directors.

How long does a civil court case take?+
It depends on the court, the complexity of the matter and whether the other side defends it. An undefended claim can be finalised in a few months, while a defended High Court trial can take well over a year. We give you an honest estimate at the start and keep you updated as it moves.
Magistrate's Court or High Court?+
The value and type of the claim largely decide which court has jurisdiction. Smaller claims are generally cheaper and quicker in the Magistrate's Court. We advise you on the right forum before anything is issued.
I received a summons. What now?+
Act immediately. A summons sets a short period within which you must give notice of your intention to defend. If you miss it, the other party can apply for default judgment against you. Contact us with the summons as soon as you receive it.
Can I recover my legal costs if I win?+
The court usually orders the losing party to pay a portion of the winner's legal costs, but rarely all of them. We explain the likely costs position before you decide to litigate.
Is there a time limit to sue?+
Yes. Most ordinary debts and claims prescribe after three years, and some claims have shorter notice periods. If you think you have a claim, get advice sooner rather than later.
