A notary public is an attorney admitted by the High Court to draw up and authenticate certain deeds and documents. Notarial deeds carry particular legal weight and, in many cases, must be registered in the Deeds Office to be effective against third parties.

We prepare, execute and attend to the registration of notarial documents, and we certify and authenticate documents that need to be used outside South Africa.

Questions

Frequently asked questions.

General information only, not legal advice on your specific matter. For advice on your situation, speak to one of our directors.

What is a notary public?+
A notary is a practising attorney who has passed an additional examination and been admitted by the High Court to prepare and authenticate notarial deeds. Only a notary can execute certain documents, such as antenuptial contracts and notarial bonds.
When must an antenuptial contract be signed?+
It must be signed before a notary before the marriage takes place, and then registered in the Deeds Office within three months of signature. If it is not done in time, you are married in community of property.
Can you notarise documents for use overseas?+
Yes. We can prepare notarial certificates and certified copies for use abroad. Depending on the country, the document may also need an apostille or further authentication, and we explain the steps involved.
Which leases need to be notarial?+
A long lease, generally one for ten years or longer, needs to be notarially executed and registered against the property title to be enforceable against a new owner or creditors. We advise whether your lease falls into this category.
