Family matters carry emotional weight as well as legal consequences. We take the time to understand your situation, explain your options in plain language and help you make decisions you will not regret later.

Where agreement is possible, we work towards it, because a negotiated outcome is usually faster, cheaper and kinder to everyone involved, especially children. Where it is not, we represent you firmly in court.

Questions

Frequently asked questions.

General information only, not legal advice on your specific matter. For advice on your situation, speak to one of our directors.

How long does a divorce take?+
An uncontested divorce, where both spouses agree on all terms in a signed settlement agreement, can often be finalised within a few months. A contested divorce takes considerably longer and depends on the issues in dispute and the court roll.
What is the difference between a contested and uncontested divorce?+
In an uncontested divorce both spouses agree on everything: the division of assets, maintenance and arrangements for the children. In a contested divorce one or more of those issues is in dispute and the court has to decide.
How is child maintenance calculated?+
Both parents have a duty to support their children according to their means. The court looks at the children's reasonable needs and each parent's income and expenses. We help you prepare a realistic budget and supporting documents.
Who gets care of the children?+
There is no automatic preference for either parent. The court's guiding principle is the best interests of the child, and the Office of the Family Advocate may be involved to assess what arrangement serves the child best.
Do we need an antenuptial contract?+
If you marry without one, you are married in community of property by default, which means you share one joint estate, including debts. An antenuptial contract lets you choose a different regime. It must be signed before the marriage and registered in the Deeds Office.
