Questions

Frequently asked questions.

General information only, not legal advice on your specific matter. For advice on your situation, speak to one of our directors.

What is voluntary sequestration?+
It is a court application in which you surrender your estate because your debts exceed your assets. A trustee is appointed to sell your assets and distribute the proceeds to creditors. The court must be satisfied that sequestration will be to the advantage of your creditors.
What is the difference between sequestration and debt review?+
Debt review is a process under the National Credit Act where a debt counsellor restructures your repayments, and you keep your assets. Sequestration is a court process where your estate is handed to a trustee. Each has different consequences, and we help you compare them.
How long does insolvency last?+
Rehabilitation happens automatically ten years after sequestration. In certain circumstances you can apply to court for rehabilitation much earlier. We advise you on when and how.
What can I keep if I am sequestrated?+
Certain essential items, such as basic household furniture, tools of trade and some insurance benefits, are protected within limits. Most other assets vest in the trustee. We explain what applies in your case before you decide.
Can my company be saved?+
Sometimes. If there is a reasonable prospect of rescuing the company, business rescue may be an alternative to liquidation. Directors of a company in financial distress have specific duties, so get advice early.
